Terms & Conditions for Online Payments

1. Definitions and Acceptance

  • "The Merchant" refers to Procom Middle East Audio and Lighting Systems Trading LLC.
  • "Payment Service Provider" (PSP) refers to Network International.
  • "User" or "Customer" refers to any individual or entity utilizing the Merchant’s payment services.
  • By accepting these Terms and Conditions, the User agrees to be bound by them and is authorized to register for and avail of the payment services, including "Pay-by-Link" and online checkout.

2. Payment and Card Security

  • Data Privacy: The User understands that personal and financial data transmitted over the internet may be susceptible to misuse or fraud.
  • Third-Party Processing: The Merchant does not store, view, or have access to any credit/debit card information on its servers. All payment processing is handled securely by the PSP.
  • Liability Waiver: While the Merchant uses industry-standard security through its PSP, the Merchant does not guarantee that the use of these services is immune to unauthorized access or data theft. The Merchant is not liable for any damages resulting from system errors, communication failures, or unauthorized hacking.

3. Lawful Use of Payment Instruments

  • The User warrants that all credit/debit card details provided are accurate and that they are the lawful owner or have explicit authorization from the owner to use the card.
  • The User is responsible for ensuring that the nominated card has sufficient credit/funds at the time of the transaction to cover the full order amount, including any applicable fees or VAT.

4. Chargebacks and Fraud

  • "Chargeback" refers to any transaction refused, debited, or charged back to the Merchant’s account by the acquiring bank or card issuer, including associated penalties and bank fees.
  • The User agrees to contact their bank or card issuer directly regarding any fraudulent transactions. The Merchant is not responsible for providing compensation for damages resulting from the misuse of a User’s card by a third party.

5. Refund Policy

  1. Approval: All refunds are subject to the Merchant’s internal sales and return policies.
  2. Deductions: In the event of a refund, the User shall bear all transaction-related costs. The Merchant will refund the net amount received, deducting any non-refundable fees charged by the bank or the Payment Service Provider.
  3. Original Method: Refunds will be processed strictly to the original card used at the time of purchase.
  4. Inspection: For physical goods, refunds will only be initiated after the returned items have been received at our fulfillment center and passed a technical inspection for condition and completeness.
  5. Timeline: Please allow 7 to 14 business days for the refund to reflect in your account, depending on your bank's internal processing times.

6. Limitation of Liability

The Merchant shall not be liable for any monetary or incidental damage suffered by the User due to:

  • Delays, interruptions, or corruption of data during the payment process.
  • Operational errors or technical failures of the "Pay-by-Link" system or the PSP’s gateway.
  • Any computer viruses or communication line failures that occur during the transaction.

7. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Dubai Courts.
